These Terms of Use ("Terms") govern your access to and use of the HomePilot website, applications, and related services (collectively, the "Service") provided by HomePilot ("HomePilot," "we," "us," or "our").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You may use the Service only if you are legally able to enter into a binding contract under applicable law. If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
The Service is not intended for children under 13.
2. The Service
HomePilot is an educational and planning tool intended to help users:
- create and manage an account;
- complete onboarding;
- estimate a potential homebuying budget;
- adjust budgeting assumptions;
- receive a personalized checklist and timeline;
- track progress;
- save homes manually; and
- manage profile and planning information.
The Service is provided for informational and educational purposes only.
3. No Financial, Legal, Tax, Mortgage, or Real Estate Advice
HomePilot is not a mortgage lender, broker, real estate brokerage, legal service, tax advisor, insurance provider, or financial advisor.
The Service does not provide:
- mortgage approval;
- underwriting decisions;
- credit decisions;
- legal advice;
- tax advice;
- investment advice; or
- real estate agency services.
Any budget range, affordability estimate, monthly payment estimate, checklist, state-specific guidance, timeline, rate assumption, or other output is only an estimate based on assumptions, limited inputs, and generalized logic. Actual loan terms, homebuying costs, eligibility, and outcomes may differ materially.
You are solely responsible for consulting your own lender, attorney, tax advisor, financial advisor, agent, insurer, or other qualified professional before making homebuying or financial decisions.
4. Account Registration and Security
To use certain features, you may need to create an account. You agree to:
- provide accurate and current information;
- keep your login credentials confidential;
- promptly update your information if it changes; and
- notify us immediately of any unauthorized use of your account.
You are responsible for activity that occurs under your account to the extent permitted by law.
5. Acceptable Use
You agree not to:
- use the Service for any unlawful purpose;
- impersonate another person or misrepresent your affiliation;
- interfere with or disrupt the Service or its infrastructure;
- attempt to gain unauthorized access to accounts, systems, or data;
- scrape, copy, or harvest data from the Service except as expressly permitted;
- upload malicious code, viruses, or harmful material;
- use the Service to spam, phish, or defraud others;
- reverse engineer or attempt to discover source code except to the extent restricted by applicable law; or
- use the Service in a way that could harm us, our users, or third parties.
6. User Content
You may provide content through the Service, such as notes, saved home entries, links, profile information, and feedback ("User Content").
You retain ownership of your User Content. However, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, process, and display User Content solely as reasonably necessary to operate, provide, secure, improve, and support the Service.
You represent that:
- you own or control the necessary rights to your User Content; and
- your User Content does not violate any law or the rights of any third party.
We may remove or restrict User Content if we believe it violates these Terms or creates risk for the Service or others.
7. Third-Party Content and Services
The Service may include links to or integrations with third-party websites, listing services, maps, calculators, vendors, or other content. We do not control and are not responsible for third-party content, products, services, or policies.
Your use of third-party services is governed by the third party’s own terms and policies.
8. Intellectual Property
The Service, including its design, software, text, graphics, branding, and other content provided by us, is owned by or licensed to HomePilot and is protected by applicable intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.
You may not copy, modify, distribute, sell, sublicense, publicly display, or create derivative works from the Service except as expressly permitted by us in writing or by applicable law.
9. Feedback
If you provide suggestions, ideas, or feedback about the Service, we may use that feedback without restriction or compensation to you.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEPILOT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR ACCURATE.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
- BUDGET ESTIMATES OR OTHER OUTPUTS ARE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SITUATION;
- THE SERVICE WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS;
- SAVED THIRD-PARTY LINKS OR THIRD-PARTY PROPERTY INFORMATION WILL REMAIN AVAILABLE OR CURRENT; OR
- DEFECTS WILL ALWAYS BE CORRECTED.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEPILOT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
- ONE HUNDRED U.S. DOLLARS (US $100).
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless HomePilot and its affiliates, officers, directors, employees, contractors, and licensors from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your use of the Service;
- your User Content;
- your violation of these Terms; or
- your violation of applicable law or the rights of a third party.
13. Suspension and Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if:
- you violate these Terms;
- we believe your use poses risk to the Service, other users, or third parties; or
- we are required to do so by law.
You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, dispute provisions, and other continuing obligations.
14. Modifications to the Service
We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms and revise the “Last Updated” date. By continuing to use the Service after updated Terms become effective, you agree to the revised Terms.
16. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles, except to the extent preempted by applicable federal law.
17. Venue
Unless otherwise required by applicable law, any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in New York, New York, and each party consents to the personal jurisdiction and venue of those courts.
18. Miscellaneous
These Terms constitute the entire agreement between you and HomePilot regarding the Service and supersede prior or contemporaneous understandings on that subject.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms is not a waiver of that provision.
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
